However, Texas law prohibits service of process on Sunday due to: Rule 6. Suits Commenced on Sunday: No civil suit shall be commenced nor process issued or served on Sunday, except in cases of injunction, attachment, garnishment, sequestration, or distress proceedings, provided that citation by publication published on Sunday shall be valid. (Amended Oct.3, 1972, eff. Feb 1, 1973)

What does a process server do?

Process servers are used to complete various tasks in the legal system, such as filing court papers, serving legal documents and document retrieval. However, their primary job is to serve (deliver) legal documents to a defendant or a person involved in a legal court case. The process of handing the documents to the person acts as a way to prove that the papers are in the hands of the defendant, or person cited on the legal documents. This way they cannot say that they didn’t know about the case they are involved in.

To provide further proof of delivering the documents, a verification is offered. This is usually called an affidavit of service or proof of service, which must be notarized and given to the individual or company who required the papers to be served. Missing any step in this process could cause issues with the rest of the legal process. This is why hiring a professional process server is important.

Why is service of process important?

In order for to help insure that all parties involved in a legal case are treated fairly, the United States and each State have developed a code of conduct and laws which are called the due process of law. One of the processes of law is to notify someone that a legal case is being brought against them. This give them a chance to develop their side of case and gives them a fair chance in court.

Service of process is necessary part of the due process. Unless notification is handled correctly then someone can claim that due process wasn't upheld and this could have serious legal consequences. Also, a court is not able to rule on a case relating to the person mentioned in the legal papers unless they have been given due notice that the court is making a decision about them. If the process of serving the legal documents isn't done correctly and within laws, then this causes a problem. In some cases, this could mean having the case dismissed.

Making sure that legal papers are processed correctly and within the guidelines of the law is essential part of the legal process. This is not an activity that can be left up to just anyone.
